1. About Pilbara Art Collective
Pilbara Art Collective (PAC) is a curated online marketplace showcasing authentic art and handmade pieces from artists with a genuine connection to the Pilbara region of Western Australia. PAC operates as a platform connecting buyers with independent sellers; each seller manages their own listings, fulfilment, and customer communications.
By placing an order through PAC you are purchasing directly from an individual seller. PAC facilitates the transaction and provides platform and payment infrastructure, but the seller is responsible for the goods and their dispatch.
2. Placing an Order
2.1 How to Purchase
Browse the PAC website and add items to your cart. At checkout you will be asked to provide your delivery address and payment details. All prices are displayed in Australian Dollars (AUD) and include GST where applicable.
2.2 Order Confirmation
Once your payment is processed you will receive an email confirmation. This confirmation is your receipt and proof of purchase. If you do not receive a confirmation within 24 hours, please check your junk folder before contacting us.
2.3 Accuracy of Listings
PAC and its sellers make every effort to represent products accurately through photographs and descriptions. However, please be aware that:
- Colours may vary slightly due to screen calibration differences
- Handmade items may have minor natural variations — this is part of their character
- Dimensions are approximate unless stated otherwise
If a product is significantly not as described, you are entitled to a remedy under Australian Consumer Law (see Section 5).
2.4 Cancellations
If you need to cancel an order, contact the seller as soon as possible via the PAC platform. Cancellations can only be accommodated before the item has been dispatched. Once an item has been shipped, it cannot be cancelled — you would need to follow the returns process instead.
3. Payment
3.1 Payment Methods
PAC accepts payment via the methods available at checkout, processed securely through Stripe. Accepted methods typically include:
- Credit and debit cards (Visa, Mastercard, American Express)
- Apple Pay and Google Pay (where available)
- Other methods as displayed at checkout
3.2 Payment Security
All transactions are encrypted and processed through Stripe, a PCI-DSS compliant payment gateway. PAC does not store your card details. If a payment fails, please check your details and try again, or contact your bank.
3.3 Currency & GST
All prices are in Australian Dollars (AUD). GST is included in the displayed price where applicable. A tax invoice can be requested by contacting PAC after your purchase.
3.4 Pricing Errors
In the rare event that a product is listed at an incorrect price due to a typographical or system error, PAC reserves the right to cancel the order and issue a full refund. We will notify you as soon as possible if this occurs.
4. Shipping & Delivery
4.1 Shipping Costs
Shipping costs are calculated at checkout based on your delivery address and the item(s) ordered. The total shipping cost will be displayed before you confirm payment.
4.2 Dispatch Times
Sellers are required to dispatch orders within 3–5 business days of receiving your order confirmation. Many sellers dispatch sooner. If your item has not been dispatched within this window, please contact the seller via the PAC platform.
4.3 Delivery Timeframes
Delivery timeframes depend on your location and the shipping method selected. As a general guide:
- Metropolitan areas: 3–7 business days after dispatch
- Regional areas: 5–14 business days after dispatch
- International: timeframes vary by destination country
4.4 Tracking
Where tracking is available, sellers will provide tracking information after dispatch. You may receive this via email or through your PAC account. If you have not received tracking details within 5 business days of your order confirmation, please contact the seller.
4.5 Delivery Issues
If your order is lost, significantly delayed, or arrives damaged, please contact the seller in the first instance. If the matter is not resolved, escalate to PAC. We will work with the seller to find a fair resolution.
4.6 International Orders
PAC ships to selected international destinations. For international orders:
- Import duties, taxes, and customs fees are the buyer's responsibility
- Delivery times may be extended due to customs processing
- Some items may be restricted or prohibited in certain countries — it is the buyer's responsibility to check local regulations
5. Returns, Refunds & Australian Consumer Law
5.1 Your Rights Under Australian Consumer Law
As a buyer in Australia you have rights under the Australian Consumer Law (ACL) that cannot be excluded. Under the ACL, you are entitled to a remedy if a product:
- Is faulty or defective
- Is not fit for its intended purpose
- Does not match its description or the sample shown
- Does not meet acceptable quality standards
In these cases you are entitled to a repair, replacement, or refund, depending on whether the fault is major or minor.
5.2 How to Request a Remedy
If you believe you are entitled to a remedy:
- Contact the seller within a reasonable time of receiving the item (we recommend within 14 days)
- Provide your order number, a description of the issue, and photographs where possible
- Allow the seller 2–3 business days to respond
If the seller does not respond or you cannot reach a resolution, contact PAC and we will assist.
5.3 Change-of-Mind Returns
Because PAC sellers are independent artists producing handmade work, change-of-mind returns are at each seller's individual discretion. Some sellers may accept them; others may not. The seller's return policy will be stated on the listing.
If a seller accepts a change-of-mind return:
- The item must be returned in its original, unused condition
- Return shipping costs are the buyer's responsibility
- A refund will be issued once the item is received and inspected
5.4 Non-Returnable Items
The following items are generally not eligible for return unless faulty:
- Custom or personalised pieces made to order
- Items that have been used, altered, or damaged after delivery
- Digital products or downloadable content
5.5 Refund Processing
Approved refunds are processed back to your original payment method. Please allow 3–5 business days for the refund to appear, depending on your bank or card provider.
6. Cultural Sensitivity & Authenticity
6.1 Authentic Pilbara Art
All works on PAC are from artists with a genuine connection to the Pilbara region. PAC curates the platform to ensure authenticity and cultural respect. When you buy from PAC, you are directly supporting independent Pilbara artists and their communities.
6.2 Aboriginal Artwork
Some works on PAC incorporate Aboriginal cultural elements. PAC requires that all such works are created with appropriate cultural permissions. As a buyer, please treat these works with the respect they deserve:
- Do not reproduce or commercially exploit purchased artwork without the artist's written permission
- Understand that some imagery may carry cultural significance
- If you have questions about a work's cultural context, contact the seller before purchasing
6.3 Certificates of Authenticity
Some sellers may provide a certificate of authenticity with their work. If this is important to you, check with the seller before purchasing or enquire via the PAC platform.
7. Privacy & Your Information
PAC collects personal information (name, email, delivery address, payment details) to process your order and communicate with you. Your payment details are handled securely by Stripe and are never stored by PAC.
PAC may use your email address to send order updates and, with your consent, occasional marketing communications. You can unsubscribe from marketing emails at any time.
PAC will not sell or share your personal information with third parties except where required to fulfil your order (e.g. sharing your delivery address with the seller) or as required by law.
8. Disputes & Contact
8.1 Resolving Issues
If you have a problem with your order, we encourage you to:
- Contact the seller directly via the PAC platform in the first instance
- Allow 2 business days for a response
- If unresolved, contact PAC with your order details and we will mediate
8.2 PAC's Role
PAC acts as a platform facilitator. While we will always try to assist in resolving disputes fairly, PAC's liability is limited to the value of the transaction in question. PAC's decision in unresolved disputes between buyers and sellers is final.
8.3 Contact Us
For any questions about your order, these terms, or PAC generally, please contact us via the details on our website. We aim to respond to all enquiries within 2 business days.
